Austin DWI Attorney | Texas DWI Legislation Update Part 2

This is part 2 of my posts on an update of Texas DWI related legislation considered by the 82nd Texas Legislature that affect an Austin DWI Attorney and others. Here is Part 1 of my Texas DWI law update.House Bill 1199 was passed and will become Texas law on September 1, 2011. HB 1199 increases the penalties for Texas DWI convictions where the driver’s alcohol concentration was 0.15 or more.

For DWI offenses occurring on or after September 1, 2011, what was a class B misdemeanor DWI (first offense DWI) now becomes a class A misdemeanor if the driver’s alcohol concentration was 0.15 or more. And a DWI is a 2nd degree felony if the driver caused “serious bodily injury to another in the nature of a traumatic brain injury that results in a persistent vegetative state.” Senate Bill 1787 was passed and becomes law on September 1, 2011.

This bill includes in the DIC-24 warning language that an officer may apply for a warrant to withdraw the driver’s blood if the driver refuses to submit a specimen.
